Preamble

These conditions of sale are entered into by SASU CASSE MARINE on the one hand, and by any individual or legal entity wishing to make a purchase via the CASSE MARINE ENLEVEMENT website, hereinafter referred to as “the buyer”, on the other.

The site is the property of CASSE MARINE in its entirety, as well as all related rights. All reproduction, in whole or in part, is subject to the systematic authorization of the owners. However, hypertext links to the site are permitted without specific request.

1. Acceptance of conditions

The customer acknowledges having read, at the time of placing the order, the special conditions of sale set out on this screen and expressly declares accepting them without reservation.

The present general conditions of sale govern the contractual relationship between CASSE MARINE and its customer, both parties accepting them without reservation. These general terms and conditions of sale shall prevail over any other terms and conditions appearing in any other document, except in the event of prior, express and written derogation.

2. Products

The photographs illustrating the products are not part of the contract. CASSE MARINE cannot be held responsible for any errors that may have been introduced. Most of the products offered by CASSE MARINE to its customers are available on our premises and in stock. In the event of a product ordered being out of stock, we reserve the right to supply our customers with equivalent compatible products.

New products, in particular spare parts, may be of adaptable brand and not original. This in no way compromises their functionality or performance.

3.Commande

Automatic recording systems are considered as proof of the nature, content and date of the order. CASSE MARINE confirms acceptance of the order to the customer at the e-mail address provided. The sale will only be concluded once the order has been confirmed. CASSE MARINE reserves the right to cancel any order from a customer with whom there is a dispute concerning the payment of a previous order. The information provided by the purchaser when placing an order is binding: in the event of an error in the recipient’s contact details, the seller cannot be held responsible for the impossibility of delivering the product.

4. Delivery

After confirmation of the order, CASSE MARINE undertakes to deliver to its carrier all the references ordered by the purchaser within a maximum of 5 working days if the product is immediately available. This carrier undertakes by contract with CASSE MARINE to deliver the order to the purchaser’s address provided by CASSE MARINE . In the case of cash on delivery, the customer undertakes to pay the carrier or its representative the full amount indicated on the order confirmation.

In addition, for deliveries outside mainland France, the customer undertakes to pay all taxes due on the import of products, customs duty, value added tax and any other taxes due under the laws of the country in which the order is received. Deliveries in EEC countries are made by La Poste in Colissimo expert against signature, Europe tracking, Chronopost or by courier according to the customer’s choice. For deliveries outside the EEC, deliveries are made by the international postal services or Chronopost according to the customer’s choice. In the case of a technical product, the customer must take particular care to check that the device delivered is working properly, and to read the instructions supplied with it.

In the event of apparent defects, the purchaser benefits from the right of return under the conditions set out in this document.

War, riot, fire, strikes, accidents and the impossibility of obtaining supplies are considered to be cases of force majeure which relieve the seller of his obligation to deliver. Goods always travel at the consignee’s risk. Always check your parcel on arrival. You have 48 hours to make any reservations with the carrier in the event of shortage or damage.

For reasons of availability, an order may be delivered to the customer in several instalments. The customer only pays for one delivery. If the customer requires 2 delivery locations, he/she places 2 orders, with the associated delivery charges.

5. Withdrawal

You have 14 days from receipt of items or service order to form an opinion. In the event of an exchange or refund, please return the item(s) in their original, undamaged packaging, together with any accessories, instructions and documentation, to the following address: 26 rue Barthélémy Thimonnier 13500 Martigues, France.

If the right of withdrawal is exercised, CASSE MARINE is obliged to reimburse the sums paid by the customer, free of charge, with the exception of the cost of returning the goods. Refunds are due within a maximum of 14 days.

To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (e.g. letter sent by post, fax or e-mail) by post to Trusted Shops GmbH, Subbelrather Straße 15c, 50823 Cologne, Germany. by telephone at +33 1 70 70 70 50 or by e-mail at [email protected].
In order for the withdrawal period to be respected, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the expiration of the withdrawal period.

6. Awards

The price is expressed in euros.

The price indicated on the product sheets does not include transport.

The price indicated in the order confirmation is the definitive price, expressed inclusive of all taxes and including VAT for new products and services and VAT on the margin for second-hand products (It is therefore not displayed and its value is 0.00€ on your orders) for France and EEC countries. This price includes the price of the products, handling, packaging and storage costs, transport and commissioning costs.

The prices invoiced are those in force at the time of the order or, if different, those shown on the quotation. CASSE MARINE nevertheless reserves the right to change its selling prices in the event of significant changes in its purchase prices.

7. Payment

The goods sold remain the property of CASSE MARINE until full payment has been received.

The price invoiced to the customer is the price indicated on the order confirmation sent by CASSE MARINE.

The price of the products is payable in cash on the day the order is placed.

Payment is made by credit card bearing the CB (credit card) symbol. Online, VIA STRIPE e-transaction allows you to pay via a bank server in a secure environment.

Your credit card number is therefore directed to the bank’s servers, and your payment is made directly to a bank in a secure environment, without passing through the store’s server. This guarantee is all the more important as your numbers are known only to our banking partner, Stripe. The order validated by the customer will be considered effective only when the banking payment centers concerned have given their agreement. In the event of refusal by the said centers, the order will be automatically cancelled and the customer notified by e-mail. Furthermore, CASSE MARINE reserves the right to refuse any order from a customer with whom a dispute exists.

In the event of late payment, a fixed indemnity for collection costs of €40 will be applied in accordance with article D. 441-5 of the French Commercial Code.

Failure to pay an invoice by the due date renders all sums due immediately payable, regardless of any payment facilities previously granted.

8. Disputes

This contract is governed by French law. CASSE MARINE cannot be held responsible for any damage of any kind, whether material, immaterial or physical, which may result from the malfunction or misuse of the products marketed. The same applies to any product modifications made by the manufacturer. CASSE MARINE’s liability will, in any event, be limited to the amount of the order and cannot be held liable for simple errors or omissions that may have occurred despite all the precautions taken in the presentation of the products.

In the event of difficulties in the application of the present contract, the purchaser has the possibility, before any legal action, of seeking an amicable solution, notably with the help of :

a professional association in the sector, a consumer association or any other advisor of its choice. Please note that the search for an amicable solution does not interrupt the “short period” of the legal warranty, nor the duration of the contractual warranty. As a general rule, and subject to the discretion of the courts, compliance with the provisions of this contract relating to the contractual warranty assumes that the buyer honors his financial commitments to the seller.

Complaints or disputes will always be received with attentive benevolence, good faith always being presumed in those who take the trouble to explain their situations. In the event of a dispute, the customer will first contact the company to obtain an amicable solution.

Failing this, the Commercial Court of Aix en Provence shall have sole jurisdiction, regardless of the place of delivery and method of payment accepted.

9. Warranty

In all cases, CASSE MARINE cannot be held responsible for non-compliance with regulatory and legislative provisions in force in the country of receipt. CASSE MARINE’s liability is systematically limited to the value of the product in question, at its date of sale, and without any possibility of recourse against the brand or company producing the product.

In any case, the customer benefits from the legal guarantee of eviction and hidden defects (Art.1625 et seq. of the French Civil Code). Provided the buyer can prove the latent defect, the seller is legally bound to repair all the consequences (art.1641 et seq. of the French Civil Code); if the buyer goes to court, he must do so within a “short period” from the discovery of the latent defect (art.1648 of the French Civil Code). New spare parts come with a one-year commercial warranty (excluding electrical and electronic products). New electrical and electronic spare parts are not covered by this warranty.

10. Legal information

The personal information collected for distance selling purposes is compulsory, as this information is essential for processing and routing orders, and drawing up invoices and warranty contracts. Failure to provide this information will result in the order not being validated. In compliance with the French Data Protection Act (Loi Informatique et Libertés), the processing of personal data relating to customers has been declared to the French Data Protection Authority (Commission Nationale de l’Informatique et des Libertés – CNIL). The customer has the right to access, modify, rectify and delete data concerning him/her (article 34 of the French law of January 6, 1978), which he/she may exercise by contacting CASSE MARINE . Furthermore, CASSE MARINE undertakes not to communicate, free of charge or in return for payment, its customers’ contact details to a third party.

11.LIABILITY AND MATERIAL RISKS AFTER PURCHASE OF A USED PRODUCT

Once you have purchased your product from us, we strongly recommend that you seek the advice and/or services of a professional with knowledge of the boating industry before installing and/or servicing it.

Casse Marine enlèvement is in no way responsible for the breakage or breakdown of the customer’s equipment after the customer has used the second-hand product purchased (spare parts, engine and/or boat). By purchasing from our online store, you accept that the second-hand product purchased is sold as is, without commercial warranty and in its exact sales description. We do our utmost to carry out the best possible checks before shipping the product to ensure that it is as functional as possible. When you buy second-hand, you know and accept the risk involved.
